You must report an accident within 90 days, or you could face being disqualified from WC benefits. In fact, any on-the-job injury should be reported to the employer immediately. The employer or its workers’ compensation insurance carrier should file a claim with the Commission (South Carolina Workers’ Compensation Commission); however, the employer or its workers’ compensation insurance carrier does not always file a claim with the Commission.  An injured worker has two years from the date of accident to file a claim with the South Carolina Workers’ Compensation Commission in order to toll the statute of limitations and protect the right to bring the claim.

If an injured worker is unable to work because of the work injury, the workers’ compensation insurance carrier should provide temporary WC benefits until the injured worker reaches the point of Maximum Medical Improvement (the point at which additional medical treatment will not improve his/her condition); however, with some exceptions, in no case may compensation exceed five hundred weeks.  The five hundred week limitation applies to the combination of both temporary and permanent compensation, although certain exceptions to that rule exist.
